Verbal Opt-In Policy for SMS/Text Messaging

Purpose This policy governs how staff obtain and document consumer consent to receive text messages when that consent is given verbally (e.g., over the phone, at an event, or in person) rather than through a web form.

When Verbal Opt-In Applies Use this process only when a written/digital opt-in (web form, keyword text-to-join, checkbox) isn't practical — for example, phone-based sign-ups, tabling events, or door-to-door canvassing.

Required Script Elements Every verbal opt-in must include, at minimum, the following spoken to the consumer:

  1. Identify the sender. State the organization's name clearly (e.g., "This is [Org Name]").

  2. State the purpose. Describe what kind of messages they'll receive (e.g., "We'll send you updates about upcoming events" or "campaign action alerts").

  3. Disclose frequency. Give a reasonable estimate (e.g., "up to 4 messages per month").

  4. Disclose costs. State: "Message and data rates may apply."

  5. Disclose opt-out method. State: "You can reply STOP at any time to opt out."

  6. Confirm affirmative consent. Ask a direct question requiring a "yes" — e.g., "Can I confirm you'd like to receive text updates from us at this number?" Silence, a nod (in person), or continuing a conversation does NOT count as consent — you need an explicit verbal "yes."

  7. Do not condition anything on consent. Never require SMS opt-in as a condition of receiving a service, signing a petition, or attending an event.

Documentation Requirements Because verbal consent isn't self-documenting like a web form checkbox, staff must log the following immediately after the call/interaction:

  • Phone number provided

  • Date, time, and method (phone call, in-person, event name)

  • Name of staff member who obtained consent

  • A note confirming the script above was followed and the consumer said "yes"

  • If possible, an audio recording or contemporaneous CRM note as backup evidence

This record should be retained for as long as the number remains in the messaging list, plus a reasonable buffer after opt-out (commonly 4+ years, consistent with TCPA statute of limitations).

Prohibited Practices

  • No pre-checked or assumed consent

  • No inferring consent from a prior business relationship alone

  • No sharing/selling the opted-in number to third parties without separate consent

  • No re-adding a number that has opted out (STOP) without fresh consent

State Law Note Some states (e.g., Louisiana) impose additional requirements on top of federal TCPA rules, such as specific hour restrictions or state-level do-not-call registry checks. Confirm state-specific rules for the jurisdiction where the consumer is located before deploying campaigns broadly.
